Residential Real Estate Transactions, more commonly known as “closings,” involve the transfer of title from one person, trust, partnership or corporation to another. Dicker and Dicker represents either the Seller or Buyer of a house, townhouse, or condominium. We provide personal and prompt attention to our clients and remain in constant contact with all of the other individuals associated with a closing such as the real estate brokers, mortgage brokers, lenders, other attorneys and title company representatives. We endeavor to have the closing process proceed smoothly and timely while protecting our clients’ interests.
Representing the Seller:
Dicker and Dicker provides the following services when representing the seller:
- Review the contract;
- Negotiate modifications to the contract;
- Prepare title work and title commitment through Chicago Land Agency Services and Chicago Title Insurance Company; (Joanne Pyes Dicker is an attorney/ agent)
- Clear title issues such as liens, mortgages, and municipal transfer stamps;
- Order of necessary documents such as survey, lender pay-off letters, Waiver of Right of First Refusal (condominiums); Paid assessment letters (Condominiums, Town homes, or Homeowner associations);
- Prepare closing documents, including but not limited to the following: Deed, Bill of Sale, Affidavit of Title, Closing Statement, Municipal, County and State Transfer Declaration forms and Power of Attorney;
- Attend the closing including examination of the Settlement Statement.
Representing the Buyer:
Dicker and Dicker provides the following services when representing the buyer:
- Review the contract;
- Negotiate modifications to the contract;
- Review Good Faith Estimate from lender, discussing the charges and costs of the loan with the buyer;
- Monitor all contingency dates in the contract;
- Discuss with client the types of holding title to the property such as Tenants in Common, Joint Tenancy, Tenancy by the Entirety; Land Trust or other Trust;
- Review and explain all of the lender documents including, but not limited to Note, Mortgage, Riders, Good Faith Estimate, and Truth in Lending.
- Review title commitment;
- Attend closing including examination of the Settlement Statement.
